In 2017, I successfully secured planning permission against a planning appeal for the continued use of a live/work unit in Maldon, Essex.
The site involved a mixed-use building designed to combine residential accommodation with workspace, allowing occupation linked to business activity.
Live/work units can present unique opportunities, but they often come with tightly worded occupancy conditions and complex planning restrictions.
In this case, the objective was to regularise the planning position and retain the flexibility needed for the occupier to continue living and working from the site.
The Planning Issue
The primary issue related to whether the occupation of the building complied with the original planning permission and associated conditions.
Concerns had been raised regarding the lawful use of the property, creating a risk of enforcement action if the planning position could not be justified.
I prepared and managed the planning appeal strategy, addressing the Council’s concerns around occupancy, use, and compliance with the approved live/work arrangement.
The appeal case demonstrated that the use remained appropriate in planning terms and that the proposal did not result in unacceptable harm.
Planning matters involving live/work units often require careful interpretation of planning conditions, lawful use arguments, and a clear understanding of how mixed-use occupation is assessed.
Appeal Outcome and Next Steps
The Planning Inspector agreed with the case presented and allowed the appeal, securing the future of the development while avoiding formal enforcement proceedings.
This case demonstrates the importance of obtaining specialist planning advice where enforcement risk and planning appeals overlap.
