In 2014, Maldon District Council's Planning Committee approved planning permisison for 75 dwellings and 1,000 sq m of commercial floorspace at North Fambridge, Essex, following extensive negotiation with the Council.

The sites lay outside the defined settlement boundary, but planning permission was secured by demonstrating that the Council could not evidence a five-year housing land supply.

The Planning Issue in Maldon

Maldon District Council had designated settlement boundaries within which residential development was expected to be concentrated. But the application site fell outside those boundaries. Ordinarily this would have made securing planning permission very difficult.

The critical planning argument was that the Council's housing policies were out of date because it could not demonstrate a five-year housing land supply as required by the National Planning Policy Framework.

Where a local planning authority cannot evidence sufficient housing supply, its restrictive policies carry reduced weight and the NPPF's presumption in favour of sustainable development becomes the primary decision-making framework.

A comprehensive case was prepared demonstrating how the application met the requirements of sustainable development.

A key strand of the argument was North Fambridge's rail connectivity — the village's advantageous position on the local rail network was used to demonstrate that the sites represented a sustainable and accessible location for new homes.

The scheme's 75 market and affordable dwellings alongside meaningful community and commercial floorspace, significantly enhancing the sustainability of the settlement.

This application was approved at Planning Committee following extensive negotiations with Maldon District Council.
