The Planning Appeal Process

Planning appeals in England are determined by the Planning Inspectorate.

The most common procedure is written representations, where both parties – the appellant and the local planning authority – submit their cases in writing.

For more complex or contentious applications, a hearing or inquiry may be more appropriate.

The time limit for most planning appeals is six months from the date of the decision notice.

For householder applications (extensions and domestic alterations), the deadline is shorter at 12 weeks.

Appeals against non-determination – where the council has failed to decide an application within the statutory timeframe – carry their own deadlines.
