In 2018, I secured a Certificate of Lawfulness for an existing House in Multiple Occupation (HMO) in the London Borough of Newham, successfully averting enforcement action linked to the borough’s 2013 Article 4 Direction.
HMOs in Newham
The client, a private landlord, had already obtained an HMO licence for the property but was facing scrutiny from the Council regarding the planning status of the use.
Following the introduction of the Article 4 Direction, changes of use from a standard dwellinghouse (Use Class C3) to a small HMO (Use Class C4) required planning permission across the borough.
The Council therefore required evidence that the HMO use had been established before the direction came into force and had continued uninterrupted since that time.
Unlike many residential uses, which can become lawful after four years, HMOs affected by the Article 4 Direction required evidence of more than ten years’ continuous use to demonstrate immunity from enforcement action.
I developed a detailed evidence strategy to demonstrate the continuous occupation of the property as an HMO over the required period. This involved reviewing and coordinating a wide range of documentation, including tenancy agreements, utility records, council tax information etc
The Council accepted the evidence submitted and issued the Certificate of Lawfulness, formally confirming the lawful HMO use of the property and bringing the enforcement investigation to a close.
Certificates of Lawfulness can be essential where long-established HMO uses are questioned in areas affected by Article 4 Directions.
A well-structured evidential case is often critical to success, particularly where councils apply heightened scrutiny to occupation records and continuity of use.
