In 2009, I successfully secured a Certificate of Lawfulness for the continued residential use of a live/work unit in Stratford, within the London Borough of Newham.

The application related to a property had been occupied as a self-contained flat (Use Class C3) rather than as a live/work unit.

The Council approved the application and confirmed that the residential use was lawful.

Demonstrating Continuous Residential Occupation

The key issue in this case was evidencing that the property had operated as a residential flat for a sufficient period of time to become lawful through the passage of time.

To support the application, I compiled and submitted detailed tenancy agreements and supporting evidence demonstrating continuous residential occupation of the property.

This evidence established that the unit had been used solely as a dwellinghouse rather than for any mixed live/work purpose.

By presenting a clear and robust evidence base, the application demonstrated on the balance of probability that the residential use was lawful and immune from enforcement action.

The London Borough of Newham approved the Certificate of Lawfulness, formally confirming the lawful continued use of the property as a flat within Use Class C3.
