In 2017, Maldon District Council approved a change of use from Class B2 general industrial to Class D2 leisure for a personal training studio, despite a policy restricting changes of use within the designated B-use employment area.

The case was resolved through pragmatic engagement with officers, vacancy marketing evidence, and compelling arguments about the lack of demand for B2 use at the site.

Overcoming Class B2 Planning Policies in Maldon

My client ran a successful personal training business with an established local client base and urgently needed new premises after their existing site was sold.

An extensive search had found only one viable site in Maldon that met the specific requirements of the business — but that site lay within an area designated for Class B uses only, where local policy restricted any change of use.

The Council was initially resistant to approving a departure from its employment policy.

The approach taken was one of pragmatic and constructive engagement: material considerations were identified that made a limited, evidence-based departure from policy sensible and proportionate in this specific case.

The case included extensive marketing evidence demonstrating that the unit had been vacant for over a year without attracting a commercial occupier in B2 use.

The personal training studio was also shown to generate local employment and provide a service to the community.

Maldon District Council accepted these arguments and approved the change of use.
