In 2015, Chelmsford City Council approved a change of use from general industrial (B2) to storage and distribution (B8) for an expanding business, despite a 2005 planning condition that had explicitly restricted any further change of use.

The case was resolved by arguing that the condition was outdated and contrary to national planning policy and government directives.

The Planning Condition Issue in Chelmsford

A planning issue arose when an expanding business needed to change the use of its premises from B2 (general industrial) to B8 (storage and distribution).

The initial assessment suggested that this change of use would normally fall within permitted development rights under Part 3, Class B of the General Permitted Development Order, as the floorspace involved was below the 500 sq m threshold.

However, a planning application had been granted in 2005 for a change of use of the unit from B1 to B2, and that consent had been subject to a restrictive condition that expressly prevented any further change of use without formal consent from the Council.

This condition therefore blocked the use of permitted development rights and required a full planning application.

The planning case submitted to Chelmsford City Council argued that this restrictive condition was no longer appropriate.

The existence of permitted development rights for B2 to B8 conversions was cited as clear evidence that central government considered such changes acceptable in principle, and that the 2005 condition — drafted at a time when policy was more restrictive — was now out of step with national planning policy and government guidance on removing barriers to employment uses.

The Council accepted this argument, and planning permission was granted without any restrictive conditions — giving the business the flexibility it needed to grow.
