In 2021, I secured planning permission for the unusual change of use of a residential dwelling to a Class E(g)(i) office at a mixed-use neighbourhood centre to the north of Colchester.

The case reversed the typical office-to-residential direction of travel, and was resolved by demonstrating that the wider site already benefited from extant planning permission for commercial uses, establishing the principle of commercial development at this location.

Change of Use to an Office

I secured planning permission for the change of use of a residential dwelling to a Class E(g)(i) office building at a site to the north of Colchester.

The site was located within an area designated as a mixed-use area in the Council's adopted Core Strategy — a designation that supports a range of commercial uses alongside residential — but the loss of any residential unit remains a matter that local planning authorities commonly resist.

This application was unusual in its direction of travel. In the current planning environment, where national policy and permitted development rights strongly encourage the conversion of offices to residential use, an application to do the reverse — convert a dwelling to offices — runs directly against the prevailing policy grain.

Local planning authorities are alert to the reduction in housing stock that any such proposal represents, and will typically resist it unless compelling justification is presented.

It was argued that the proposed use would complement the existing commercial activity at the neighbourhood centre, add to its vibrancy, and support the growth and expansion of a local business, creating additional local employment.

Colchester City Council accepted the argument and granted planning permission.
