In 2022, Westminster City Council approved planning permission for the change of use of a former betting shop near Charing Cross to a sui generis hot food takeaway for a vegan, plant-based fast-food operator. Westminster's takeaway policies are among the most restrictive in the country.

I overcame the Council's initial resistance through detailed negotiation with the planning officer and the Council's environmental health team, demonstrating the proposal would not harm the character of the area or residential amenity.

Change of Use to Hot Food Takeaway in Westminster

I secured planning permission from Westminster City Council for the change of use of a ground floor unit near Charing Cross to a hot food takeaway for a vegan plant-based fast-food operator.

Westminster City Council applies some of the most restrictive policies on hot food takeaway uses in the country. The Council actively resists over-concentrations of takeaway uses, particularly where they are close to residential properties or where they might undermine the vitality and character of a shopping frontage.

The application site was last used as a betting shop — itself a sui generis use — so the change of use required a fresh planning application.

The Council's initial response was resistant.

I engaged directly and at length with the planning officer and with the Council's environmental health team, demonstrating why this proposal was fundamentally different from a conventional takeaway.

The operator served plant-based food only, with an internal air recirculation ventilation system that eliminated the fumes, smells and noise issues typically associated with hot food preparation. The use would diversify healthy food options in a transport hub area and support the site's function as a destination for commuters and tourists.

Following those discussions, the Council accepted the proposal would not harm the character of the area or the amenity of nearby residents, and planning permission was granted.
