In 2016, I secured a successful outcome at enforcement appeal for a residential property in Harrow, London, involving a number of external works including a home gym, poolside changing room, garden structures and raised land levels.

The development had been carried out to enhance the functionality of the property, providing high-quality ancillary accommodation for the household.

The key objective was to demonstrate that these additions were appropriate in planning terms and consistent with residential use.

Outbuildings such as home gyms are commonly acceptable where they remain incidental to the main dwelling and do not form independent units.

The Planning Issue

The case arose following the service of an enforcement notice by the London Borough of Harrow, which alleged multiple breaches of planning control and sought demolition and removal of the structures.

The central issue was whether the works caused any demonstrable planning harm and whether the Council’s response was proportionate.

Through the enforcement appeal, I undertook a detailed assessment of what had been built against adopted policy and relevant case law.

I identified that the majority of the development complied with policy and that there was a clear lack of evidence to substantiate the Council’s claims of harm.

Importantly, I argued that enforcement action should be remedial—not punitive—and that solutions should be explored rather than defaulting to demolition.

The Planning Inspector agreed with my position and allowed the appeal, with the majority of the development retained.
