In 2018, Westminster City Council approved a planning application for garden flat alterations in St John's Wood Conservation Area. These works to the windows and doors, would resolve an outstanding enforcement notice served on the homeowner.

A prior enforcement appeal had been dismissed, but the case was resolved through direct negotiation with the Council, producing a revised scheme that Westminster's planning team could accept.

Heritage Issues in St John's Wood, Westminster

A homeowner in St John's Wood came to us after Westminster City Council had served an enforcement notice requiring them to reverse a range of improvements made to the rear windows and doors of their property.

The property lay within a conservation area, and Westminster applies stringent controls over alterations to buildings in these sensitive locations — including changes that might appear straightforward, such as replacing windows and doors, where the rules on whether planning permission is required or not are not always clear-cut.

An enforcement appeal had already been made and unfortunately refused before specialist input was sought.

However, a dismissed appeal does not always mean the end of the road.

In this case, the most productive path forward was to explore what amended proposals the Council might be willing to support, and to use that understanding to prepare a fresh application.

Taking a rnegotiation-led approach, discussions were held directly with Westminster City Council to understand precisely what the officers required in order to grant permission.

Those discussions informed a revised scheme, which addressed the Council's specific conservation area concerns whilst retaining improvements that genuinely enhanced the functionality of the property. The amended proposals were then submitted as a new planning application.

Westminster City Council approved the application, bringing the enforcement process to a close and allowing the homeowner to retain the works in their revised form.
