In 2022, Colchester City Council approved planning permission for the change of use of two residential outbuildings to holiday-let units in a conservation area village near Colchester, on the Essex/Suffolk border.

The case required overcoming restrictive pre-existing planning conditions on the outbuildings, heritage constraints arising from the setting of an adjoining listed building, and flood risk considerations — all while demonstrating the proposal would bring genuine economic and tourism benefit to the local area.

Holiday-Let Approved Planning Permission in Rural Colchester

I secured planning permission from Colchester City Council for the change of use of two existing residential outbuildings to holiday-let units in a conservation area village near Colchester.

The growing popularity of UK-based holidays had led my client to explore converting underused outbuildings into short-term tourist accommodation — a growing and commercially viable sector.

The application raised four distinct planning issues, each of which required careful management.

First, the outbuildings were subject to pre-existing planning conditions restricting their use to sleeping accommodation ancillary to the main dwelling. I put forward robust evidence demonstrating why the issues those conditions were designed to control were no longer relevant, given changes in the site's circumstances since they were imposed.

Second, the site fell within a conservation area, and one of the outbuildings physically adjoined a listed building. The proposal required careful scrutiny of the impact on the heritage significance of both the listed building and the conservation area.

Third, flood risk assessments were required to demonstrate that the proposed holiday-let use would not be exposed to unacceptable risk.

Fourth, the impact on neighbouring amenity had to be considered — holiday accommodation can generate noise and activity at times that are different from standard residential use.

I addressed all four matters systematically through the application, and Colchester City Council approved the change of use without conditions that would prevent the use from operating commercially.
