In 2016, Basildon Borough Council approved planning permission for the change of use of an empty office to a D2 martial arts and fitness academy in Essex, overturning a previous refusal.

The case was resolved by undertaking a sequential test identifying no preferable alternative sites, compiling marketing evidence to demonstrate the absence of commercial demand, and challenging the Council's outdated vacancy rate assessments.

Change of Use Issues in Basildon

Basildon Council had previously refused planning permission for the change of use of a vacant B1a office unit to a D2 leisure facility — a martial arts and fitness academy — on grounds relating to the loss of industrial premises contrary to local planning and economic policy.

The case was taken over following that refusal, and a resubmission strategy was developed.

The refusal turned on concerns about the loss of an employment-designated unit in an out-of-town location.

Addressing this required two strands of evidence. First, a sequential test was carried out to identify whether any more suitable or sequentially preferable sites were available within the area. The search confirmed that no alternatives could accommodate the academy's specific operational requirements, and that the industrial unit was the only viable option for the client — whose proximity to their existing client base was commercially critical.

Second, evidence was compiled to demonstrate that the site had been adequately marketed for over three years without attracting any commercial occupier.

Vacancy rates across the wider employment designation were analysed, which revealed a high proportion of empty floorspace and indicated that the land designations were not being actively reviewed by the Council — contrary to NPPF guidance on keeping land designations under review.

After proactive engagement with Basildon Borough Council and submission of this comprehensive evidence package, the change of use was approved.
