In 2018, Mid Sussex District Council approved planning permission for a new three-bedroom dwelling to replace an existing modular building near East Grinstead, completing the second phase of a long-term planning strategy.

Phase one had established the lawful residential status of the site through a Certificate of Lawfulness in 2017; phase two then leveraged that position to secure permission for a substantially larger replacement home, overcoming constraints including proximity to ancient woodland and a buffer zone.

Mid Sussex Planning Policies

Planning permission was secured from Mid Sussex District Council for the replacement of an existing modular dwelling near East Grinstead with a new, larger three-bedroom home.

The modular building had been constructed without planning permission in 2003 and used as a residential dwelling continuously since that time.

Phase one of the planning strategy had been to obtain a Certificate of Lawfulness in 2017, establishing the building's lawful residential status. With that secured, pre-application discussions were held with the Council to establish the parameters for a replacement dwelling — the second and more ambitious phase of the scheme.

The replacement planning application faced a number of site-specific and policy constraints.

The site was in close proximity to an area of ancient woodland and fell partially within an identified buffer zone, where development is sensitive.

Additional constraints relating to the site's rural location and highway access also required careful management and specialist input.

Pre-application engagement with Mid Sussex District Council informed the design and layout of the proposed replacement dwelling, ensuring it addressed the Council's concerns from the outset.

The planning case demonstrated that the new building would represent a significant improvement over the modular structure in terms of design quality, visual impact and environmental performance, and that it would not cause harm to the ancient woodland or its buffer zone.

The Council was satisfied that the scheme met the required planning tests and granted permission.
