In 2015, the London Borough of Lambeth approved a multi-faceted scheme to modernise an NHS dental surgery and convert redundant upper floors into two new residential units. T

he case required overcoming a contrary local policy seeking to protect the building's D1 community use designation, and was resolved through early pre-application engagement and a solution-led approach to policy justification.

Lambeth's Planning Policy Issues

The London Borough of Lambeth was the local planning authority for this case, which involved a terraced building occupied by an NHS dental surgery across all four floors.

Modern practice and improved administrative technologies had rendered much of the upper space surplus to operational requirements, leaving it in disrepair.

The proposal sought to modernise and concentrate the dental surgery within the ground floor and basement, whilst converting the redundant upper floors into two new residential flats.

The key planning obstacle was UDP Policy 26(c), which seeks to resist the loss of community uses — in this case the D1 designation on the upper floors. Lambeth's initial response to the scheme was negative, and it was clear that a straightforward application without specialist input would face significant resistance.

The planning case was then built around demonstrating that the proposal would not, in any meaningful sense, result in a loss of healthcare provision — rather, it would concentrate and improve the surgery, enhancing accessibility and modernising the service for NHS patients.

The justification was framed against the London Plan and the NPPF, identifying the material planning gains delivered across the spectrum of sustainable development.

Lambeth revised its initial position and granted planning permission for this innovative, demonstrably sustainable scheme.
