In 2016, I successfuly won a planning appeal for the development of 3 no. dwellings on land just outside the settlement boundary of North Chailey, in Lewes Distict, East Sussex.

The scheme evolved from an earlier, larger proposal that had been refused. This scheme was carefully refined to deliver a smaller number of well-designed homes within a sustainable edge-of-village location.

The site formed part of a substantial residential garden, benefiting from mature landscaping and natural screening—allowing the development to integrate sensitively into its surroundings.

The objective was to deliver high-quality housing that responded to local need while making efficient use of underutilised land.

The Planning Issue

The key issue centred on the site’s location outside the settlement boundary, where development is typically resisted under local policy.

The Council ultimately refused the application on policy grounds, claiming they had an up-to-date five-year housing land supply.

Through the planning appeal, I demonstrated that this position carried limited weight. Evidence showed that housing delivery in the area was tightly constrained and that the settlement boundary was overly restrictive and effectively out of date.

I also reinforced the site’s sustainability credentials—highlighting its relationship with existing ribbon development and access to nearby services.

Crucially, I set out that a modest scheme of three homes would not undermine plan-making but would instead provide an immediate and meaningful contribution to housing supply.

The Planning Inspector agreed with my case and allowed the appeal, concluding that the benefits of delivering housing outweighed conflict with settlement boundary policy.

This case demonstrates how a planning consultant can successfully challenge restrictive policy positions and unlock small-scale residential development in rural locations.
