Planning Approved by Braintree for a Car Valeting Business
Planning permission secured from Braintree District Council for a sui generis change of use for a hand car wash and valeting facility in Essex, on a site outside the designated employment area.

In 2015, Braintree District Council granted planning permission for the change of use of a site to a hand car wash and valeting business — a sui generis use — in Essex.
The key challenge was that the site lay just outside the Council's designated employment area, requiring a positive case to demonstrate that the proposal was nonetheless appropriate in its location.
The Braintree Planning Issues
Braintree District Council operates local policies that direct employment uses towards designated employment areas, where housing, jobs and services can be co-located sustainably.
When a client sought planning permission for a hand car wash and valeting facility — a sui generis use that sits outside the standard use class framework — the fact that the proposed site lay just beyond the boundary of a designated employment area created a policy hurdle.
Sui generis uses are those which fall outside any formal use class and therefore require planning permission regardless of their relationship to other uses. Examples include theatres, houses in multiple occupation, petrol filling stations, and — as in this case — hand car wash and valeting businesses.
The proposed scheme involved the redevelopment of the site to provide car washing facilities, including an office kiosk and three car parking spaces.
A robust planning case was prepared and submitted to Braintree District Council, presenting the car wash as a complementary and much-needed service for the local area.
The argument demonstrated that the proposed use would not cause any detrimental impact on the surrounding area and that, notwithstanding its location outside the designated employment zone, the site was functionally appropriate for this kind of commercial activity.
Braintree District Council was persuaded and granted planning permission.
