In 2019, Mid Sussex District Council approved a retrospective planning application for the retention of a small timber outbuilding in the rear garden of a dwelling in Crawley Down, West Sussex, to be used as a hairdressing studio by the occupier of the house.
The key planning challenge was justifying a commercial use within a wholly residential area, resolved by demonstrating that the scale, hours and conditions of use meant the material circumstances outweighed any policy harm.
Home-Based Business in Mid Sussex
Retrospective planning permission was obtained from Mid Sussex District Council for the retention of a small outbuilding in the rear garden of a semi-detached dwelling at Crawley Down, West Sussex, to be used as a hairdressing studio.
The building — a modest timber structure of 3m x 2.4m set on a brick plinth, with wide glazing and doors to the front elevation — had been erected without planning permission and internally fitted out with a single chair and sink, with no realistic prospect of any other use.
The primary planning challenge was one of principle: Policy DP1 of the Mid Sussex District Plan supports economic development but seeks to direct business uses to appropriate locations.
A new commercial use operating from the rear garden of a dwelling in a wholly residential area raised questions about potential harm to the amenity of surrounding neighbours and the character of the area.
However, the material circumstances of the proposal were strongly in its favour.
The scale of the operation was minimal — a single chair, serving one client at a time, operated solely by the resident of the property on Wednesdays, Fridays and Saturdays only.
The limited size of the building meant the use could not readily be intensified.
No objections were received from the council's consultees or neighbours.
Mid Sussex District Council concluded that the material circumstances outweighed any policy harm and that the development complied with District Plan Policies, the Crawley Down Neighbourhood Plan, and the NPPF.
