7 New Homes Approved in Little Clacton

In 2026, I secured Technical Details Consent from Tendring District Council for seven new dwellings on land to the rear of an established residential scheme near Little Clacton, Essex, following a permission in principle that had earlier been allowed at appeal.

The application needed to translate that outline consent into a detailed, deliverable scheme addressing design, drainage, ecology and highway safety across a 0.33-hectare site bounded by mature hedgerows, a bridleway and a public footpath.

The Planning Challenge

The site adjoined an earlier phase of housing, served by an access already approved.

When the Council refused Permission in Principle for a further seven dwellings, I took the case to appeal. Central to the appeal was the Council's five-year housing land supply position: Tendring's Strategic Housing Land Availability Assessment demonstrated only a 3.22-year supply against a requirement of 1,063 homes a year, engaging the tilted balance at paragraph 11(d) of the NPPF.

The appeal was allowed, establishing the principle of residential development on the site.

Bringing the Detail Forward

With the principle of development secured, I prepared the Technical Details Consent application, briefing the architect and techncial consultants. This application covered the detailed design, layout, scale, appearance, landscaping and access arrangements for the seven dwellings.

The scheme followed the development pattern of the adjoining first phase.

An Arboricultural Impact Assessment confirmed no trees or hedgerows needed to be removed, and a Preliminary Ecological Appraisal confirmed no ecological issues existing.

Resolving Highways and Drainage Issues

Essex Highways initially sought conditions requiring the relocation of an existing zebra crossing on the approach to the site. I successfully argued that this requirement was neither necessary nor reasonable. The Council agreed that the request failed the tests of paragraph 57 of the NPPF and did not impose it.

On drainage, I worked through an initial objection from Anglian Water over surface water disposal, resolving the matter through a pre-commencement condition.

The Planning Outcome

Technical Details Consent was granted, allowing the seven dwellings to proceed to construction.
