In 2025, the London Borough of Croydon issued a Certificate of Lawfulness confirming that an outbuilding in South Croydon had been in continuous use as a self-contained residential dwelling for more than four years, making the use lawful under the four-year rule.
I assembled and presented a comprehensive evidence package that met the balance of probability standard required.
4 Year Rule Used in Croydon to Establish Continued Use as Dwelling
I secured a Certificate of Lawfulness from the London Borough of Croydon for a client whose outbuilding in South Croydon had been converted and used as an independent residential dwelling without planning permission.
The Certificate confirms that the use is now lawful under Section 191 of the Town and Country Planning Act 1990 — immune from enforcement action and eligible for formal legal recognition.
The four-year rule is a well-established principle in planning law. Where a building had been in continuous use as a single dwellinghouse for four years without enforcement action, that use becomes lawful by operation of statute.
Assembling the evidence is the critical task.
I worked closely with the client to gather and organise the documentation needed to demonstrate continuous occupation throughout the relevant period.
A clear legal commentary accompanied the application, explaining the applicable statutory provisions, citing relevant case law.
The London Borough of Croydon accepted the evidence and issued the Certificate.
