HMO Planning Appeal Win in Walthamstow, London
Planning Appeal allowed for HMO conversion in Walthamstow, London after floor space and parking objections overcome.

In 2026, I won a planning appeal against the London Borough of Waltham Forest for the change the use of a single-family dwelling from a Use Class C3 dwelling house into a small House in Multiple Occupation (Use Class C4).
The Council's refusal centred on Local Plan Policy that places restrictions HMO conversions and on concerns regarding highway safety and on-street parking pressure within the property's Controlled Parking Zone (CPZ).
How the HMO Planning Appeal Was Won
The central dispute was one of measurement.
The Council's calculation of the original floor space had excluded the basement level from its assessment. We argued this exclusion was unjustified. There was nothing in Policy or its supporting text distinguishes basements from other original floor space, and the basement in question was fully enclosed and integrated into the property.
The Planning Inspector agreed, accepting our calculation once the basement was properly included, comfortably clearing the local thresholds.
With that hurdle overcome, we demonstrated compliance with the remaining planing policy requirements related to space standards, cycle parking, refuse storage, amenity space, and proximity to public transport (the site benefits from a PTAL rating of 6a).
On highway safety, we had pre-empted the Council's concerns by submitting a signed Unilateral Undertaking preventing future occupiers from obtaining resident parking permits, securing a car-free development. The Planning Inspector agreed that this UU met the tests set out in the NPPF and CIL Regulations.
The planning appeal was allowed.
Lesson for Homeowners and Landowners
This case is a reminder that a council's refusal reasons are not always the final word, particularly where calculations or policy interpretation are open to challenge. A well-evidenced planning appeal can turn a refusal into a permission.
