In 2026, I acted as the planning consultant for the applicant in securing a Section 73 variation of condition permission in Colchester. This application allowed an already-approved residential scheme to be refined and enlarged. Colchester City Council granted the permission.

My client had purchased the site at auction with an existing planning permission already in place.

Rather than accept the approved scheme as drawn, my client engaged me to review the design and identify where genuine improvements could be made, e.g. better internal layouts, more generous room sizes, and additional bedroom accommodation.

The site already benefited from an acceptable principle of development, an agreed access strategy, and a suite of technical approvals - ecology, drainage, contamination remediation - that had already been worked through with the Council and statutory consultees.

Reopening all of that unnecessarily would have added cost, delay and risk.

Colchester City Council granted the variation of condition application.

The result for the client - a scheme purchased with consent for a good, but standard, pair of dwellings, refined into a materially improved product with larger, more attractive accommodation — secured without having to restart the planning process or renegotiate the principle of development.

As demonstrated here, an approved scheme is a starting point, not a ceiling. Planning permission purchased at auction reflects what a previous owner or their team chose to submit — not necessarily what the site is capable of delivering. A second look by an experienced planning consultant can often unlock meaningful improvements.
