In 2026, I successfully secured full planning application for the change of use of a Class E(g) office building at Great Notley, Braintree, to a Class C3 residential dwelling.
The building had originally been converted from former horse stables for office use. The proposed conversion was largely internal, with the only external alteration being the insertion of a single casement window in the side elevation
The Planning Context
The planning history was particularly relevant. Three earlier applications for residential conversion at the site had been refused and subsequently dismissed at appeal, with the most recent appeal decision dating from 2015.
However, the planning context had changed since those decisions.
A subsequent review of the settlement boundary brought the site within the defined development boundary of Great Notley.
This meant that the principle of residential development could be reconsidered against the current planning policy framework rather than simply repeating the arguments made in the earlier applications.
The change in the settlement boundary was an important factor in reassessing whether residential use was now appropriate.
Loss of office accommodation - The proposal involved the loss of a small Class E(g) office building. The premises were vacant and the surrounding area was predominantly residential in character.
The application therefore considered the effect of losing the existing employment floorspace and whether there was a continuing need for the premises to be retained for office use.
Given the scale and circumstances of the vacant accommodation, the loss of the office use was accepted by the council.
Providing a suitable standard of accommodation - As part of the conversion, the proposed dwelling needed to meet the relevant residential space standards.
This required careful consideration of the floor area within the roof space, particularly where the sloping roof resulted in restricted headroom.
Improving the private garden - The quality and usability of the proposed private amenity space was also considered during the application.
Reviewing previously refused proposals
A previous refusal does not necessarily prevent a proposal from being reconsidered in the future. Planning decisions need to take account of the policies and circumstances that apply when a new application is determined.
