Planning Appeal Win to Vary Conditions for Ramsgate Café
Successful planning appeal against Thanet District Council securing extended opening hours for a café in Ramsgate, after the Council had failed to determine a variaton of conditions application.

In 2025, I acted as planning consultant in a successful appeal against Thanet District Council, securing extended opening hours for a café and retail premises at 2–3 The Broadway, Addington Street, Ramsgate.
The application sought to vary an existing condition restricting opening hours, extending them to 22:30 on Sundays to Thursdays and 23:00 on Fridays, Saturdays and Bank Holidays.
The Council failed to determine the application within the prescribed timeframe, leading my client to lodge an appeal against non-determination.
The Planning Issue
The key planning issue centred on whether the extended hours would harm the living conditions of neighbouring residential occupiers, particularly in respect of noise, disturbance and anti-social behaviour.
Nearby residents had raised concerns about the existing operation, including the use of a rear outdoor kitchen and noise from patrons.
I helped prepare a robust case, supported by a Noise Management Plan (NMP), which addressed concerns raised by the Council's Environmental Health Officer.
The NMP included measures such as isolating sound systems, restricting outdoor smoking at the front of the building and implementing staff training.
The Inspector allowed the appeal, granting new planning permission with conditions reflecting the NMP and setting clear operational limits.
The appeal subsequently was allowed.
