Successful planning appeal against Thanet District Council for two new dwellings at Ramsgate, overcoming concerns about character and appearance and securing Habitats Regulations mitigation.

In 2023, I successfully appealed a planning refusal against Thanet District Council, securing permission for the erection of two dwellings with associated parking and external works at Ramsgate.

The Council had refused the application, citing concerns about the effect on the character and appearance of the area and the impact on living conditions of neighbouring occupiers, with particular regard to noise and disturbance.

A third issue arose in relation to the site's proximity to the Thanet Coast and Sandwich Bay Special Protection Area and associated Sites of Special Scientific Interest.

The Planning Outcome

On character and appearance, I demonstrated that street the appeal site was located on had a varied and inconsistent street scene, with multiple outbuildings, garages and extended properties.

The proposed dwellings would be set back significantly from the road and largely hidden from public view.

I showed that their scale and one-and-a-half storey form would be modest within the plot and consistent with the established varied built character.

On neighbour amenity, I argued that the shared access serving only two dwellings would generate minimal vehicle movements, and that proposed parking and turning areas were positioned away from habitable rooms at neighbouring properties.

To address the Habitats Regulations, a signed Unilateral Undertaking was issued providing a financial contribution to the Council's Strategic Access Management and Monitoring Plan. Natural England confirmed this would provide effective mitigation.

The appeal was allowed subject to conditions.
