In September 2026, I secured planning permission on appeal for a garden outbuilding in the Whitstable Town Conservation Area, overturning a refusal by Canterbury City Council.
Listed Building and Conservation Area Constraints in Whitstable
The proposal was a single-storey garden room with a personal gym and shower room, sited in the rear garden of a house in a busy, high-density part of Whitstable.
The site lies within the Whitstable Town Conservation Area, alongside a Grade II listed neighbouring building, and also falls within Flood Zone 2.
Canterbury City Council refused the application, so I lodged an appeal on behalf of the homeowner, under section 78 of the Town and Country Planning Act 1990.
Our case showed that a modest, well-designed building could sit comfortably within the area's tight urban grain.
Planning Appeal Allowed Against Canterbury City Council
The Inspector agreed with the case put forward.
Having regard to its footprint relative to the retained garden, its limited height, fenestration pattern and choice of materials, the outbuilding was found to be proportionate to the host property and subordinate to it and the surrounding buildings.
It would not harm the setting of the listed building and would have a neutral effect on the conservation area, so both would be preserved.
The proposal was therefore found to accord with Policies DBE3 and HE6 of the Canterbury District Local Plan (adopted July 2017) and with sections 66 and 72 of the 1990 Act.
Permission was granted subject to conditions.
